Topple Yard — Terms of Service

1. Acceptance of Terms

These Terms of Use govern your use of Topple Yard (the "Game"), published by DevNPlay. By downloading, installing, or playing the Game you agree to these Terms. If you do not agree, do not use the Game.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game on a device you own or control, for your own private, non-commercial entertainment. All rights not expressly granted are reserved.

3. Acceptable Use

You agree not to:

• Modify, reverse engineer, decompile, or otherwise tamper with the Game or its data files, including to alter progress, coins, or purchased items.
• Use cheats, bots, automation, or modified clients, or exploit bugs to gain an unfair advantage on the leaderboard.
• Choose a nickname that is offensive, hateful, obscene, impersonates another person, or infringes anyone’s rights. We may remove any nickname from the leaderboard at our discretion.
• Interfere with the Game’s servers or attempt to access records belonging to other players.
• Redistribute, sell, or commercially exploit the Game or its assets.

4. In-App Purchases and Virtual Items

The Game offers optional purchases processed by Apple. Coins, boosters, lives, and other virtual items have no monetary value, cannot be exchanged for cash, and cannot be transferred outside the Game. They are a limited license to use a feature of the Game, not property you own.

All purchases are final except where required by law or by the App Store’s own refund policy. Refund requests are handled by Apple, not by us. REMOVE ADS is permanent and restorable through "Restore Purchases"; consumable items are spent on use and are not restorable. Because your progress is stored only on your device, deleting the Game will forfeit any unspent consumable items.

We may change prices, contents, or availability of items, and may add or retire items over time.

5. Advertising

The Game is free to play and supported by advertising. Rewarded ads are always optional and are offered in exchange for an in-game benefit. Purchasing REMOVE ADS permanently disables forced advertising; it does not remove rewarded ads, which remain available as a way to earn rewards without paying.

6. Progress and Availability

Your progress is stored on your device and is not backed up by us. We are not responsible for progress lost through deletion of the Game, device loss, device failure, or transfer to a new device.

The Game is playable offline. Online features — the leaderboard and the daily gift’s server-time check — depend on services we do not control and may be unavailable, changed, or discontinued at any time.

7. Intellectual Property

The Game, including its code, art, models, sound, music, and name, is owned by DevNPlay or its licensors and is protected by copyright and other intellectual property laws. These Terms grant you no ownership in it.

8. Disclaimers

The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, DevNPlay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost progress, lost virtual items, or lost profits, arising out of your use of the Game. Where liability cannot be excluded, it is limited to the amount you paid us for the Game in the twelve months before the claim. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.

10. Termination

We may suspend or terminate your access to online features, or remove your leaderboard entry, if you breach these Terms. You may stop using the Game at any time by deleting it, which also deletes your local progress.

11. Apple as a Third-Party Beneficiary

These Terms are between you and DevNPlay, not with Apple. Apple is not responsible for the Game or its content, and has no obligation to provide maintenance or support for it. Apple is a third-party beneficiary of these Terms and may enforce them against you.

12. Governing Law

These Terms are governed by the laws applicable at DevNPlay’s principal place of business, without regard to conflict-of-law rules, and without depriving you of the protection of mandatory consumer law in your country of residence.

13. Changes to These Terms

We may update these Terms as the Game changes. The revision date at the top of this page reflects the current version, and continuing to play after an update means you accept it.
